PRODUCT: Infrastructure Pollution Program (IPP)

AVAILABILITY: Available to any appropriately licensed agent or broker.

FOCUS: RT Specialty's Environmental and Construction Professional (RT ECP) Practice has a new Infrastructure Pollution Policy (IPP) Form designed to protect stakeholders from the catastrophic environmental risks commonly associated with hard infrastructure projects like roads, bridges, airports, rail and ports.

“The IPP complements the environmental insurance coverages available to agents and brokers and is designed to meet the anticipated contractual liability needs on large, hard infrastructure projects," says John J. Heft, a senior vice president at RT ECP.

“The traditional approach to insuring these project types commonly involved writing two or more pollution liability policies or balancing the limits between separate policies with possibly separate carriers to create really cumbersome risk management solutions," Heft says. “The IPP eliminates these complexities by combining the various insuring agreements into one policy form that is designed to seamlessly cover all the involved stakeholders."

COVERAGE DETAILS: The IPP is available with limits on each pollution condition up to $25 million/$25 million aggregate—higher limits are available if required by contract—and policy terms up to 13 years including completed operations. Key coverages include full sudden and gradual pollution coverage, third-party bodily injury, property damage, including natural resource damages, emergency response costs and defense expenses. The policy form includes four insuring agreements:

  • Coverage A: Contracting Services Pollution Liability Coverage
  • Coverage B: Covered Location Pollution Liability Coverage
  • Coverage C: Non-Owned Location Pollution Liability Coverage
  • Coverage D: Crisis and Reputation Management Expenses Coverage

“RT ECP has placed hundreds of project pollution policies over the past 15 years, many of them involving hard infrastructure projects," Heft says. “With an average of more than 20 years of experience in the environmental and construction-related professional liability space, RT ECP's producers and consultants are well prepared to help agents and brokers navigate the anticipated comprehensive environmental insurance requirements for hard infrastructure projects."

UNDERWRITING: To receive a quote, insureds must provide name and address of named insured, project scope of work including construction values and term, project location and, if applicable, environmental due diligence, such as Phase I Environmental Site Assessments (ESA), Phase II ESA, remedial action work plan, geotechnical reports or soil management plans.

TARGET: This product is designed for large hard infrastructure projects.

COVERAGE TERRITORY: Hard infrastructure projects conducted in the U.S.

COVERAGE AVAILABILITY: All U.S. states.
